HENRY COXE III AND JOHN F. HARKNESS JR. ALLOW LAWYERS TO "PAD" LEGAL BILLS

The first in a series of stunning observations of the Florida Bar Association under the leadership of Henry Coxe III and John F. Harkness Jr., as reported in 2008 Dark Horse Presidential candidate Victor-Hugo's Law and Justice in the United States Series is the fact that the Fifteenth Judicial Circuit Grievance Committee "E" sees nothing wrong with attorneys "padding" legal bills. Boca Raton Attorney Aaron R. Cohen bragged of being "The King of Bill Padding" telling his former client that he along with several other attorneys frequently charged clients up to 30 minutes for sending or receiving faxes and that the final outcome of settlements was often decided between attorneys early in a case based on the client's wealth and ability to pay.

Apparently, law, justice, and the rights of those seeking ethical legal counsel take a back seat to funding the student loans of unscrupulous attorneys. Aaron R. Cohen of Conde & Cohen divulged dirty little secrets of the legal profession, bragging that he would often settle a case early, then waste time along with the opposing counsel on superfluous legalities to give the appearance that work was being done on behalf of the client, when in actuality, the legal fees were simply being padded. These allegations were presented to Henry Coxe III and John F. Harkness Jr. of the Florida Bar. Both men failed to comment on why the allegations were never investigated nor why witnesses substantiating these claims were never contacted by the investigation committee.
A lie detector test was suggested to verify these claims with private funding but the Florida Bar chose to forego any investigation, or issue a reprimand for padding client bills. The failure on behalf of the Florida Bar to conduct a proper investigation essentially condones this behaviour amongst attorneys and subjects clients, particularly those involved in divorce litigation, to unchecked over-billing.
The ruling by the 15th Judicial Circuit Grievance Committee was upheld by Henry Coxe III and John F. Harkness Jr. The surprise ruling discredits the Creed of Professionalism taken by attorneys, which states:
" I will strictly adhere to the spirit as well as the letter of my profession's code of ethics, to the extent that the law permits and will at all times be guided by a fundamental sense of honor, integrity, and fair play."
"I will conduct myself to assure the just, speedy and inexpensive determination of every action and resolution of every controversy."

found nothing wrong with the over 50 questionable ethical and competency complaints made against the law firm of Conde & Cohen, P.L. The Law and Justice in the United States Series will analyze the public record accusations allegedly investigated by the Florida Bar and allow the Court of Public Opinion to decide if justice prevailed or if corruption exists within the U.S. Justice System.

The failure on the part of the Florida Bar to protect consumers from rogue attorneys calls to mind the recently exposed failure of the United States Federal Drug Administration's(FDA)failure to protect the general public from dangerous prescription medications. Of primary concern is the dangerous fact that rogue attorneys can go unchecked and eventually become ruling Judges in a death penalty state.

PAKISTAN'S PERVEZ MUSHARRAF AND CHIEF JUSTICE MOHAMMED CHAUDRY JOIN BEAUTIFUL CHAOS OF CRACKHEAD JESUS TALE
When Pakistan's Chief Justice Mohammed Chaudry challenged the legality of his President Pervez Musharraf's iron-fisted rule, Chaudry became a symbol of democratic resistance. The man who bravely defied his dictator nearly died when 15,000 law enforcement officials allowed Musharraf's militant hooligans to open fire on a crowd of protesters killing more than 40 people. Chaudry made enemies with Musharraf for ruling against his fascist regime and because he was expected to block Musharraf's attempt to illegally extend his presidency.
Last week gunmen, supposedly under orders from President Musharraf, broke into the home of a top Chaudry aide and murdered him. As the United States attempts to bring democracy and freedom to the uncivilized world, the barbaric actions of the uncivilized world reminds the United States leadership that it is not much different when it comes to handling political dissent and the extents to which government leadership will go to hide corruption.

HUGO CHAVEZ CHALLENGES FREE SPEECH WHILE HENRY M. COXE III LOWERS JUDICIAL ETHICS AND COMPETENCE
Hugo Chavez, born July 28, 1954, was elected President of Venezuela in 1998 then again in 2000 and 2006. His term as President ends in 2012. On his weekly "Larry King" style television program, Alo Presidente, Chavez proclaimed "Here [in Venezuela] we are creating our own model."

In a letter to the Florida Bar Journal (Volume 80, No. 9, October 2006) Florida Bar President Henry M. Coxe III wrote:
"When lawyers run for election as judges in Florida, I had assumed voters prefer to select them based on their experience and contributions to the profession and community. I figured voters consider what other lawyers think of their legal skills and weigh their abilities to excercise good judgement, follow the law,and remain independent of special considerations."

The words of both men hide a dirty little secret most educated people know all too well. Essentially don't believe everything you read or hear from Presidents. True, Chavez is creating a new model in Venezuela, but as 2008 dark horse presidential candidate Victor-Hugo realized first hand, on his visit to Venezuela, Chavez's new model includes censorship and an atmosphere of fear.

Henry M. Coxe III meanwhile is correct in his assumption that voters prefer to select lawyers who excercise good judgement, follow the law, and remain independent of special considerations. His actions, however, don't back his words as noted in Victor-Hugo's scathing expose of corruption within the U.S. legal system entitled Law and Justice in the U.S.
The parallel between what is occurring in Venezuela under the rule of Hugo Chavez and the dangerous standards set forth by Henry M. Coxe III in the United States is simply that power corrupts and absolute power corrupts absolutely. Hugo Chavez is able to shut down the most popular television station in Venezuela because he feels like it and Henry M. Coxe III is able to look the other way as lawyers make a mockery of his words because he can.
Hugo Chavez felt threatened by the investigative reports broadcast on the country's most popular television station, Radio Caracas Television (RCTV), so he ordered it shut down indefinately. John F. Harkness Jr. and Henry M. Coxe III chose to ignore requests for comment on the "legal mafia" weakening the U.S. Justice system in the hopes that ignoring the issue would make it go away, like Cyndi Sheehan's resolve to fight the civil war in Iraq.

WHAT WOULD CRACKHEAD JESUS DO?
The court of international public opinion has spoken loudly and the actions of Hugo Chavez are receiving worldwide condemnation as a blatant act of censorship meant to undermine the liberties of Venezuelans. The hollow words of Henry M. Coxe III will be subject to the international court of public opinion as the 2008 presidential candidate attempts to follow in the footsteps of Miami Herald Reporters Jason Grotto, Dan Christensen, and Patrick Danner, all of which were recently honored by the FLA. Bar for their efforts in uncovering corruption within the legal system.
The artist will highlight the points which are now deemed ethical and examples of exhibiting good judgement for attorneys who someday wish to be elected as judges in a death penalty state. The issues will be dealt with as part of the controversial Crackhead Jesus Series which tells the story of a corrupt CEO who uses a corrupt attorney to undermine the legal system. The butterfly effect of events which follow, lead the main character to uncover corruption and incompetence running rampant throughout the U.S. Justice system.

The artist's Law and Justice in the United States Series includes the eight fired U.S. Attorneys for which Attorney General Alberto Gonzalez is being criticized. Daniel Bogden, Paul Charlton, Margaret Chiara, Bud Cummins, David Iglesias, Carol Lam, John McKay, and Kevin Ryan will be called in to interview for an imaginary position under Henry M. Coxe III's administration. The eight applicants will be measured against the newly implemented low standards set forth by the Florida Bar under John F. Harkness Jr.'s watch.

In a state which condones Capital Punishment, the above mentioned cases set a precedent for a dangerously low standard of ethics and competence for attorneys, which threaten the safety and lives of Florida State residents. In particular, minorities who can not afford competent legal counsel will be left without their Constitutional right to a fair trial by attorneys sworn to uphold the oath of admission to the Florida Bar.
Furthermore, the condoning of attorneys from maintaining the confidence and preserving inviolate the secrets of clients, threatens the relationship between Fortune 500 Companies and government institutions that rely on attorneys in the state of Florida to abide by both the Creed of Professionalism and the Oath of Admission.
Critics like Victor-Hugo, say the disciplinary system is slow and protects the profession. "Perhaps Hugo Chavez can learn a thing or two from Henry Coxe III's Bar Association in his quest to subjigate information." The artist/activist says, adding," Apparently, the Florida Bar is run like the Mormon religion in that intellectual investigation is discouraged and dissention or questioning of authority is not tolerated."
On November 3, 2003 the Daily Business Review published the following story by Laurie Cunningham. It is apparent that in the years following this article, not much has been done by the Florida Bar to safeguard the general public against unethical attorneys practicing and working their way up to the bench, in a death penalty state.
The first grievance letter regarding Miami lawyer Louis Robles arrived at The Florida Bar office in December 1998. By 2000, the pile of letters had grown to more than 25. Then 50.
Letter after letter, the complaints were the same: “We signed the settlement papers, but have not received any money,” one Washington couple wrote.
“I have called Mr. Robles’ office about 40 times, only to get the run-around,” an Orlando man wrote.
“These lawyers are charging me for everything,” a retired Ohio laborer declared, “including the use of their computer, interest incurred in their borrowing money from somebody else to do my case, fees for doctors I have never seen, fees for the food the lawyers ate, the car they drove and every phone call they made.”
“Can’t anyone stop this man or slow him down?” another deplored.
But Robles wasn’t stopped until four years later, when The Florida Bar finally had the prominent mass tort lawyer disbarred for misappropriating more than $800,000 from his client’s trust funds. By then, some of the 8,500 clients that Robles had represented in class-action lawsuits against asbestos manufacturers had already died of cancer. Others were still waiting for their checks.
Time for a review
Although Florida Bar officials say Florida has one of the toughest attorney discipline systems in the country, some legal consumers, Republican lawmakers and attorneys who have been disciplined by the Bar complain that the system is biased, ineffective and unfair. Critics say the disciplinary wheels move much too slowly, and that the Bar is more intent on protecting lawyers, particularly well-established ones in larger firms, than in fulfilling its duty to the public.
Now, for the first time in 14 years, the Bar has decided to review its system for protecting the public from misconduct by lawyers.
In June, Bar president Miles McGrane established a 25-member Special Commission to Review Lawyer Discipline, which was charged with making suggestions for a major overhaul of the Bar’s attorney regulation system. The commission is comprised of circuit and appellate judges, lawyers, a layperson and retired Supreme Court Justice Major Harding.
The commission was established in the wake of the Robles investigation and a $750,000 public relations campaign, “Dignity in Law,” that the Bar introduced last year to improve the image of lawyers around the state.
McGrane, along with Jacksonville criminal defense lawyer Henry Coxe III, who chairs the commission, says they launched the review because the Bar hadn’t reviewed the disciplinary system since 1989, and the Bar spends $10 million a year on disciplinary activities — more than one third of its $28 million annual budget. Both denied that establishing the commission had anything to do with the Robles case.
“That’s a helluva lot of money,” said Coxe, a partner at Bedell Dittmar DeVault Pillans & Coxe. “When we’re allocating that much of our budget annually for one particular item, I don’t see why we shouldn’t make sure we’re doing it right.”
At the special commission’s first meeting in September, McGrane told the members gathered in a Tampa Marriott conference room that their assignment was open-ended.
“We’re not having this study because there are problems with the system,” McGrane said. “Your charge is very vague, to evaluate the efficacy of the discipline system and come back with recommendations. It was purposely vague because we don’t know where this study will go.”
Throughout the daylong meeting, commission members discussed complaints that the current disciplinary system takes too long and that the type of sanctions imposed on lawyers vary wildly throughout the state.
William Vose, chief assistant state attorney in Orlando, expressed concern that many lawyers who have been convicted of criminal felonies continue to practice for months before the Bar catches up with them.
Bill White, chief assistant public defender in Duval County, said public defenders are unfairly burdened with grievances filed by prisoners who are merely unhappy with their convictions. There has to be a more efficient way to dispose of the frivolous complaints, he said.
Some of the judicial members of the committee, including Pasco Circuit Judge Lynn Tepper and former Justice Harding, said that judges often report lawyers who’ve misbehaved in their courtroom, only to have the Bar do nothing.
“Judges continually complain that they make these referrals, then never hear back,” Harding said.
Seeking input
The commission, which has met twice this fall, is sending a survey to the Bar’s 72,000 members to elicit input on the disciplinary system. To get feedback from consumers, they also plan to mail the surveys to roughly 6,500 people who have filed complaints with the Bar in the last three years.
The commission will review the comments and issue a report with recommendations for changing the disciplinary system by June. The report will be reviewed by the Board of Governors and ultimately submitted to the Supreme Court for adoption.
Many of the concerns expressed by the commission members mirror the findings in a new report by HALT, an independent Washington, D.C., legal reform group founded in 1978 by Paul Hasse and Matt Valecic. The nonprofit organization has more than 50,000 members and is funded by private contributions.
In 2002, HALT rated all 50 states and the District of Columbia on the quality of their lawyer regulation systems, using data from the American Bar Association and its own state surveys. Of the 51 jurisdictions, HALT ranked Florida second in responsiveness to Bar complaints, imposition of adequate discipline and openness of its disciplinary process.
Still, Florida’s overall grade was only a C+. Massachusetts, which ranked first, got a B-. The lowest ranked states included Alaska, Kentucky, Montana, North Carolina and Pennsylvania, which came in last.
The report found a nationwide pattern of “toothless sanctions, unnecessary secrecy, biased procedures and endless delays.” Out of thousands of complaints filed against attorneys each year, the states’ discipline systems yielded only a “tiny trickle of disbarments, suspensions and reprimands,” HALT said.
The low grades among even top-ranked states such as Florida mean that the problem of inadequate attorney discipline is nationwide, said James Turner, executive director of HALT. “Most state systems are intolerably slow and overly secret, which erodes public trust,” he said. “The system should be designed to protect consumers, not lawyers. Lawyers can take care of themselves.”
But lawyers who represent those facing disciplinary prosecution insist that Florida has a tough system.
“I encourage anyone who thinks this is a good ’ole boy club to sit in on the trials or grievance committee meetings,” said Andrew Berman, a partner at Young Berman Karpf & Gonzalez in North Miami Beach, who has been representing lawyers in disciplinary cases for more than 15 years. “In most cases, lawyers who do their clients wrong get their just dessert.”
In all 50 states and Washington D.C., lawyer regulation is handled by the highest court in the jurisdiction, which then designates an organization to prosecute attorney misconduct. In 19 states including Florida, lawyer regulation is delegated to the bar.
Grievance committees
As the investigative arm of the state Supreme Court, The Florida Bar has been responsible since 1955 for prosecuting lawyers who engage in ethical misconduct. To do so, the Bar uses grievance committees and its own staff counsel to evaluate the complaints.
The grievance committees are typically comprised of nine members: six lawyers and three so-called public members, who are not attorneys. The members of the grievance committees are volunteers. There are 80 grievance committees statewide. Some judicial circuits have more than one committee to handle the high volume of grievances, such as Miami-Dade County, which has 15.
The Florida Bar is based in Tallahassee. It maintains branch offices in Miami, Fort Lauderdale, Orlando and Tampa. The branch offices are staffed by six or seven Bar prosecutors and a handful of contracted part-time investigators. The staff reviews complaints about lawyers to determine whether the allegations amount to a violation of the Rules Regulating the Florida Bar.
When Bar counsel determines that an allegation could constitute ethical misconduct, it is forwarded to one of the local grievance committees. The grievance committee then investigates the complaint to determine whether there is probable cause for unethical conduct. If so, the Bar counsel files a formal complaint with the Supreme Court.
The Supreme Court then directs the chief judge of the circuit where the accused lawyer practices to appoint a local trial judge as the so-called referee. The referee conducts a hearing and recommends sanctions, if any.
The referee outlines his or her findings and recommendations in a report, which is submitted to the Florida Supreme Court for final approval. The sanctions range from public reprimands to disbarment.
A recent example of a disbarment is the case of Alan Karten, a Miami criminal defense attorney who was permanently disbarred in October 2002 for selling a client’s classic car collection without permission while the client was in federal prison in Arkansas for a cocaine trafficking conviction.
Karten claimed it was part of a verbal agreement he had with his client, Nelson Loynaz Jr., to help pay off $30,000 that Loynaz owed the federal government. But Loynaz said he had never given Karten such authorization.
After a hearing in March 2000, the case referee, Miami-Circuit Judge Jerald Bagley, found the convict’s story more credible than Karten’s and recommended disbarment.
“The whole thing is horrendous,” Karten said after he was disbarred. “On the basis of one man’s opinion, I lose everything.”
Lawyer suspension
Suspensions, the most common disciplinary action, can range from a few days to three years. They are often the punishment in cases involving lawyers who have been convicted of criminal offenses, such as North Palm Beach lawyer John Skrandel. In January, Skrandel was suspended for three years after he was convicted of aggravated assault with a firearm for pulling a gun on a Little League coach during a dispute over use of a batting cage.
When attorneys are suspended for 91 days or more, they must prove that they have been rehabilitated before their law license is reinstated. Proving rehabilitation often involves a showing that they’ve performed community service, made restitution to their victims, undergone counseling, or attended Bar programs such as attorney ethics school, a one-day seminar that educates attorneys on avoiding conflicts of interest.
Public reprimands are often administered in cases such as that of Michael Foulkes, an immigration lawyer who was reprimanded for neglecting a client who paid him a $750 retainer to help her get a U.S. work permit.
In most cases, the complaints the Bar receives are from attorney clients, although many are referred by trial and appellate judges, other lawyers and financial institutions. The Bar does not initiate its own investigations, but responds to complaints logged with its offices.
In recent years, the Bar has received an average of 9,000 complaints a year, involving 4,500 to 5,000 lawyers. The total number of annual disciplinary actions has ranged from 391 to 472, including between 20 to 38 disbarments.
Compared to other states with similar numbers of lawyers, Florida investigated the most grievances and administered the highest amount of public sanctions in 2001, according to American Bar Association statistics.
“As a whole, I think the system works,” said Tamarac lawyer Kevin Tynan, a former Bar attorney who now represents lawyers accused of violating Bar rules.
The typical lawyer appearing before the Board of Governors for a public reprimand is an overextended solo practitioner in his or her mid-40s who simply got overwhelmed by the demands of a growing caseload, Tony Boggs, director of the Bar’s legal division, told the special committee during its September meeting in Tampa.
“They tend to be older lawyers who just weren’t equipped to deal with a burgeoning practice,” Boggs said.
To help these attorneys, the Bar often diverts them into programs such as Lawyers Office Management Assistance Services. LOMAS advisers meet with attorneys to review problems they are having managing the business side of their practices.
“The most common complaint from clients is that their attorneys don’t call them back,” said J.R. Phelps, director of LOMAS, which is based in Tallahassee. “The attorneys tell us they are too busy.”
Through LOMAS, the attorneys learn systems for logging their communication with clients and training their secretaries and paralegals to answer client questions. They also get help organizing their banking systems.
Cases are also referred to Florida Lawyers Assistance, a nonprofit organization that provides counseling for lawyers with drug, alcohol and psychological problems.
Alternatively, the Bar diverts numerous legal consumers to its Attorney Consumer Assistance Program, a consumer hotline staffed by four full-time attorneys who help clients resolve minor disputes with their lawyers.
Despite the Bar’s efforts to address its members’ shortcomings, critics of the system say the Bar is too forgiving. State Rep. Fred Brummer, R-Apopka, a frequent critic of the Bar, cites the case of former state Rep. Steven Effman as a prime example.
In April, the married Sunrise Democrat was suspended from practicing law for 91 days after pleading no contest to Bar disciplinary charges that he had sex with three female divorce clients from 1998 to 2000.
One of the women involved, a legislative aide of another House member, claimed that she and Effman not only had sex, but that he billed her for their time together. Another claimed she had to have an abortion, which Effman refused to pay for.
Five months after being suspended, Effman’s law license was reinstated. He is now back practicing divorce law in Plantation.
“Effman took advantage of several women and got only a slap on the wrist,” Brummer said. “That was a perfect example of the way the Bar lets off those who are close friends of the Board of Governors.”
Effman could not be reached for comment.
But the Bar prosecutor on the case, Joel Klaits, denied that Effman received preferential treatment. He said Effman’s sanction was appropriate because of the rehabilitation requirement of a 91-day suspension.
Before his law license was reinstated, Effman had to prove by “clear and convincing evidence” that he had been rehabilitated, Klaits said.
Over the years, Republican legislators have tried numerous times to take control of the Bar’s budget and disciplinary system. Three years ago, Brummer sponsored an unsuccessful bill to put attorney discipline under the executive branch.
But attorneys say that would be unconstitutional and unwise. “Quite simply, Article V of the Florida Constitution says that the Supreme Court has exclusive jurisdiction of lawyers,” said Richard McFarlain, a Tallahassee lawyer who was the Bar’s chief lobbyist for 35 years. “To undo that, they’d have to go after the court’s jurisdictional power and change the constitution.”
Stephen Metz, the Bar’s current lobbyist, said the Legislature hasn’t made any recent moves to take over Bar regulation. “Fortunately, the Bar has a strong case that its disciplinary procedures are more open to the public and more effective in terms of the number of cases we get involved in,” said Metz, a partner at Metz Hauser & Husband in Tallahassee.
Another political advantage of the Bar’s self-regulatory system is that it’s completely funded by member dues, rather than tax revenues, Metz said. Switching to executive branch regulation could cost the cash-strapped state lots of money.
Although legal reform groups like HALT don’t advocate turning over lawyer regulation to the executive branch, they contend that having lawyers on the grievance committees is an inherent conflict of interest. HALT recommends that non-lawyers should review disciplinary cases under the guidance of lawyers or judges.
“If a jury of non-lawyers is good enough to decide Kobe Bryant’s case, a jury is good enough to decide whether a lawyer has cheated his or her client,” Turner said. “This isn’t rocket science.”
But Coxe and other lawyers argue that attorneys must remain the primary participants because they are most familiar with the rules of practicing law, the demands of running law practices, and the challenges lawyers face representing clients in complex and contentious matters.
To have non-lawyers more heavily involved in the process would require the presence of lawyers to “constantly educate the non-lawyers about what the standards are in every single situation,” he said.
But it’s not just consumers and Republican legislators who are critical of The Florida Bar discipline system. Some attorneys who have been disciplined by the Bar also criticize the Bar for its lack of uniform sanctions.
Warren Trazenfeld, a Miami lawyer who represents plaintiffs in legal malpractice lawsuits, complained that he was investigated by the Bar twice for the same incident, and that two separate grievance committees reached opposite conclusions.
In 1998, the Bar investigated Trazenfeld for allegedly intimidating a defense witness in a legal malpractice case. The first time, the grievance committee found no probable cause for allegations that Trazenfeld had engaged in prejudicial conduct and failed to show fairness to opposing counsel.
But a year later, the Bar reopened its file on Trazenfeld after his client filed a Bar complaint against him, claiming he had ruined her case by intimidating a defense witness without her knowledge. The first investigation had been prompted by an adverse appellate ruling against Trazenfeld and his client.
The second grievance committee found probable cause that Trazenfeld violated Bar rules by engaging in prejudicial conduct and failing to keep a client properly informed.
“Two different committees looked at the same thing I did,” said Trazenfeld, who pleaded no contest to the charges in July and was suspended for 10 days. “One said there was probable cause, another said there was none. The lack of consistency is problematic.”
Those reviewing the Robles file also initially had a difference of opinion on the appropriate sanction. In January, Robles’ attorney and Bar counsel Randolph Brombacher had worked out a deal to allow Robles to surrender his law license for five years in exchange for his full cooperation with the Bar and turning over his files.
But although a disciplinary resignation is technically the same as disbarment, the Bar’s Board of Governors rejected the deal because of concern about public perception. The board instead decided to push for Robles’ disbarment.
“The charges were so egregious and we were afraid that the public wouldn’t understand that resigning and disbarment were the same thing,” McGrane said.
By the time Robles was finally disbarred in May, his case had spent 14 months under investigation by Bar counsel, 16 months before the grievance committee and two years pending trial before the case referee.
Although four years may seem like a long time to get an unethical attorney disbarred, those who participated in the grievance process defended the Bar’s work in one of the most complex and voluminous disciplinary cases it had ever prosecuted.
“I’m very proud of the result that the Bar got in that case,” said David Rothman, the designated reviewer who supervised the grievance committee that investigated Robles.
“There were so many files, it was as if we had opened Pandora’s Box,” said Rothman, a criminal lawyer and partner at Thornton & Rothman in Miami. “It wasn’t that we didn’t want to move quickly, we just wanted to make sure we knew what was going on before we did.”

JUDGE HAFELLE BANS ELECTRONIC RECORDING DEVICES IN CRACKHEAD JESUS CASE
Modern Artist Victor-Hugo held the camera outside the courtroom capturing footage for his documentary, "The Marketing of Peace". With cameras rolling, the Honorable Judge Hafele came into focus for the first time, within the confines of the courthouse where both men would meet. The artist naively peered into the eyes of the man called Judge through the camera lens and glass doors which seperated the two individuals. The Judge noticed he was being filmed and motioned to the bailiff. Those in the courtroom turned to look at the man in the suit standing outside the courtroom filming the proceedings. As the stern bailiff opened the glass doors and came into frame, the artist knew he was headed for trouble.

"The Judge wants to see you in his courtroom," Said the Bailiff." and I advise you to shut the camera off."

The artist did as instructed and entered the courtroom to meet the man who would decide his fate for the first time. Everyone in the courtroom turned to stare at him as if he were a dead man walking.
"What is your name?"
"Victor-Hugo, your Honor."
"What law firm are you with?" The Judge asked.
"None you're Honor. I am Amicus Cureau, Friend of The Court."
"What are you doing with the camera?"
"I'm filming a documentary called The Marketing of Peace, your Honor."
"Who gave you permission to film me in my courtroom?"
"Your Honor, that's why I am here today, I asked for permission to record the proceedings in my motion before The Court, Sir."
"Where's your attorney?"
"I am my own attorney, Your Honor. I am trying to show people that it is better to represent oneself than to be misrepresented by unethical and incompetent legal counsel, Sir."
The Judge paused. The artist stood still, never looking away from the man sitting up high on The Bench. Respect seemed to pass back and forth from the bench to floor, as silence filled the courtroom.


"Do you have a business card?" The Judge broke the awkward silence of the courtroom.
"Outside your honor."
"Outside in your car?"
"Outside the courtroom, Sir."
"Go get it."
"Yes, Your Honor." The artist turned to exit the courtroom.
"Before you go, Mr. Hugo." The artist turned to Judge Hafele.


"I want to make it perfectly clear to you. I do not give you permission to film me, tape record me or use my image. Should you do so, I will seek to prosecute you to the full extent of the law. Is that understood?"
In that instance, The Artist learned to respect the Judge the same way attorneys do. It is the kind of respect a young man shows his father when his father dangles a leather belt in front of him.
"Yes, Sir." The artist exited the courtroom escorted by the Bailiff. The artist handed his business card to the bailiff asking, " Was he upset?"
"Yes." The Bailiff looked at The Artist as if he were stupid.
"Should I ask him if I can film the proceedings when I go before the court? I really did put that request in my motion."
"I'm not allowed to give legal advice," The Bailiff answered. "but I wouldn't."

And so, in deference to the Judge presiding over the Crackhead Jesus Case, the judge will hence forth be known as Judge XXX.

As the story of Crackhead Jesus rolls on, one can expect Justice and the Law to find its way into the proceedings throughout the trial in much the same way justice and the law made its way through the legal intricacies which made the OJ Simpson trial such a valuable lesson for everyone.
Two trials were held in the OJ Simpson case.
One was sponsored by the U.S. Government.
Prosecuting attorneys Marcia Clark and Christopher Darden failed to prove Mr. O.J. Simpson guilty of murdering his wife during the criminal trial.



The other trial was privately sponsored. Private legal counsel prevaled during the second, civil trial, wherein Mr. O.J. Simpson was found guilty of murdering his ex-wife Nicole Brown Simpson and Ronald Lyle Goldman.
Most people remember two things about those trials. One is that Judge Lance Ito presided over the trial where the law prevailed.

UFC fans were treated to a night of upsets during the Pay Per View octogon cage matches broadcast live from Las Vegas. In a shocking upset, Quinton "Rampage" Jackson, clobbered Chuck "The Iceman" Lidell, with a series of punishing fisted blows to the head. DEMOCRATS SURRENDER, WAR CONTINUES, PRESIDENTIAL CANDIDATE SEEKS THIRD PARTY REFORM
In a spineless retraction of promises made to voters, the Democratic party gave in to the false rhetoric of politicians who would have the public believe that failing to fund the war in Iraq is unpatriotic. The fact remains, funding the war, does not equate to providing safety for American troops being sent to slaughter in the Middle East quagmire. In November, the American public resoundingly voted Democrat in the hopes that Congress would put an end to the sensless war.

Registered Republican modern artist, Victor-Hugo, has been so disgusted with the corruption and greed of his own party and the cowardly nature of the Democratic party, that he has requested the opportunity to form a third party with Democrat Al Gore. The Porn Stars For Peace segment of Victor-Hugo's Michael Moore style documentary entitled, The Marketing of Peace, deals with how sex and sexuality is being used to market more than just cars, clothes, and fast food. The artist says he realized people were coming to his website via search engines seeking words or phrases like; clitoris, vagina, nicknames for penis, how to perform cunninglingus, large breasts and fisting. This inspired the dark horse presidential candidate to use this curious fact to raise awareness about social issues using sex as an educational tool.

The video of the lovely and demure Asian, Lin Chong, simulating oral sex on a man and offering a virtual handjob while educating the viewer about political issues, is a brilliant example of how modern artists and activists are reaching a wider audience and educating the masses through virtual sex on the world wide web. MODEST MOUSE INSPIRES MODERN ART MUSIC MOVEMENT SOUNDTRACK FOR CRACKHEAD JESUS SERIES
The curious Epic Records artists, Modest Mouse, have surreptitiously aroused enough interest to gather an eclectic group of open minded followers of Modern Experimental Rock to listen to the words of Modern Artist, Isaac Brock. Lied To Generation Fans of the Modern Art Music Movement artists rejoiced in early 2007 when producer Dennis Herring released, "We Were Dead Before The Ship Even Sank" to the modern music world.

At the Bang Music Festival in Miami around the Holiday Season, Mr. Johnny Marr dared to look into the Modern Art Music Movement Camera with Modest Mouse band mate Eric Judy and simply declared to the world, "Try Peace...Peace is cool." That evening in November, the words of John Lennon morphed into a rhetorical question of sorts and seemed to reverberate amongst the audience and artists in attendance at Bicentenial Park .
The words of John Lennon have been reignited. All we are saying, is give peace a chance. It appears the Lied To Generation is now asking,
"If we, as a civilized culture have tried to live with constant war in our human existence, why not simply try peace...peace is cool. Isn't it? Has any culture ever tried living in peace succesfully? Or, does the Politics of the Penis inevitably rear its ugly head?"

2008 Hispanic Dark Horse Presidential Candidate, Victor-Hugo, who claims to represent the Lied To Generation and is seeking to start an independent Common Sense Party with Environmentalist Al Gore, says he had never heard of Modest Mouse until the big Bang Music Festival.
"I knew Jonny Marr had been with the Smiths, Electronic, and the Healers all of which are quite brilliant, but I had never actually heard anything from Modest Mouse before that night." Aaron R. Cohen has chosen to falsely report to the court, and Judge Donald W. Hafele, that investigations by the Florida Bar against him have been dismissed regarding charges of unethical practices. Failing to mention that the dangerous findings are still under review by the Chief Branch Disciplinary Council, Aaron R. Cohen is displaying the same wreckless rogue manner used by North Carolina prosecuter Mike Nifong in the Duke rape case. Nifong is presently under investigation by the Bar Association.
A documentary crew will be filming the proceedings scheduled to begin at 3:30 p.m. at the West Palm Beach Courthouse. The proceedings were rescheduled due to a family emergency which struck the life of Judge Donald W. Hafele. 2008 Dark Horse Presidential candidate and artist, Victor-Hugo, claims he was inspired by NY ARTS publisher, Abraham Lubelski and Brazilian born Romero Britto, when he created his "Modern Scream", an homage to the Father of Expressionism, Edvard Munch. The latest addition to his controversial Crackhead Jesus Series, a whimsical group of paintings which together tell a story of corruption threatening the Judicial Branch of Government in the United States, adds suggested sexuality to Edvard Munch's haunting image by inverting it.

Abraham Lubelski discovered Victor-Hugo after he saw the 2005 Miami Herald article concerning the forced censorship of his Hurricane Wilma and I Tried To Warn You About Abu Ghraib exhibits during Art Basel. Lubelski said he visited the Edvard Munch exhibit in February 2006 and was reminded of Victor-Hugo. He felt compelled to tell the young artist that he saw something in his paintings that recalled Edvard Munch's style and life. Coincidentally, in early 2006, Munch's show ran concurrently with Victor-Hugo's exhibition at the Broadway Gallery in Soho, New York City .
ABRAHAM LUBELSKI, VICTOR-HUGO, STEVEN PSYLLOS AT ART BASEL MIAMI
Lubelski was born in war-torn Magnitagorsk, Siberia. Like Britto and Victor-Hugo, he has wandered the world in search of inspiration for his art. According to Lubelski he uses surroundings to transform the mundane of daily life into observation, incident, spontaneity, serendipity and encounter. "Seizing the moment is the core of the performance; it is about desire." Lubelski says.
Critics of Lubelski claim some of his work does not look much like art. Which,is precisely what Lubelski wants. He says he intends his art work to look more like life, performed.

ABRAHAM LUBELSKI AND FRIEND
Brazilian neo-pop artist, painter, serigrapher, and sculptor, Romero Britto, combines elements of cubism, pop art and graffiti in his colorful works of art. His customers make up a whose-who A-list of art collectors and artists including Dustin Hoffman, Arnold Schwarzenegger, Michael Jordan, Gloria Estefan, Andre Agassi, Eileen Guggenheim, David Rockefeller, Senator Ted Kennedy, and Madonna. When Britto and Victor-Hugo met on U2's How To Dismantle The Bomb Tour, Britto told Victor-Hugo the reason his paintings were so popular with the masses was because he had a brilliant marketing team and because "people in the world today see enough negativity on television that they don't want to see it on their walls."
Romero Britto has been criticized by art critics and some fellow artists for being non-political and cartoonish. Victor-Hugo defends Britto's art by saying, "Not every painting has to have a message or tell a story. Britto's work is happy. Happy is good."
The Modern Art Music Movement founder goes on to compare Britto's work to the insanely popular Los Del Rio hit, Macarena, adding:

Victor-Hugo says he took both highly respected artist's advice to heart, when he sat down to create the Crackhead Jesus Series. The colorful series incorporates the knowledge gained by the artist when he interviewed various members of the legal system for his Law and Justice In The United States Expose. The artist's intimate interaction with the legal population came during a time in history when the U.S. Attorney General, Alberto Gonzalez, was under investigation for promoting an atmosphere which promoted loyalty to Washington's Executive Branch rather than loyalty to job and country.
Victor-Hugo has been dubbed the "Thinking-Man's-Britto" because the playful images found in the controversial Crackhead Jesus Series tell the serious story of modern day people whose jobs require judgement and an understanding of the laws that are to be enforced. The Crackhead Jesus Series makes up a chapter in the evolving Capicua 3-1-3: The Long Arm of the Law. The unique modern art graphic novel is being followed on the internet by law students and art fans around the world. The story is inspired by real life characters like former Deputy Attorney General James Comey, Mike Nifong, Aaron R. Cohen, John F. Harkness Jr., Roland Raymond St. Louis, and Monica Goodling.

The artist says his intention was to bring the old and the new together to create a collage of techniques on canvas while educating the general public about the U.S. justice system. Besides Britto and Abraham Lubelski, Victor-Hugo sites Zbyszek Koziol, Monet, Van Gogh, and Munch as influences for his Crackhead Jesus Series. He says he wanted to introduce the Lied To Generation to Norwegian artist Edvard Munch, a pioneer in the Expressionist movement, by incorporating a unique mixture of techniques and color.
Munch's art from the 1890s is most famous, but his later work is steadily attracting greater attention, and inspiring present-day artists, like Victor-Hugo in particular.
During a recent taping of the Learning Channel's, Miami Ink, featuring The Modern Scream, the crew argued over whether they saw testicles or breasts in the subliminal painting.

The artist says he purposefully left the sex of the figure in the Modern Scream ambigious to denote universal angst over modern corruption. "I wanted the piece to be optimistic, however. MODERN ART MUSIC MOVEMENT SALUTES SAMANTHA LARSON FOR INSPIRING LIED TO GENERATION
The international coalition of artists which make up the Modern Art Music Movement(MAMM) salute Samantha Larson for inspiring the Lied To Generation in daring to achieve and conquer seemingly insurmountable goals. The 18-year-old California woman recently became the youngest climber to scale the highest mountains on all seven continents. Samantha Larson reached the 29,035-foot summit of Everest on May 17.

Larson was 12 when she climbed Mount Kilimanjaro in Africa. Since then she has scaled the highest peaks, called the "Seven Summits",on all seven continents. 7summits.com, a Web site that records the names of those who have accomplished the achievement, states that by completing the climb in Nepal, Larson is the youngest person to have completed the "seven summits" challenge. The previous record was held by then-20-year-old British climber Rhys Miles Jones in 2006.

"There were a lot of difficult moments. It was a long trip, it was hard in general," she said. "It was one big challenge. I never gave up hope completely. Deep down I thought I would make it."
Samantha Larson provides hope and inspiration for those members of the Lied To Generation who feel they are living in a world without purpose.
Her achievement paves a positive path for femeninity in a day and age when women are making unprecedented accomplishments in all facets of life. In the year 2007, the word nigger still raises enough emotion in the United States amongst the African American community and whites that most colored people in the U.S. overlook the fact that more dark people die from black on black crime in the world today than the politically incorrect use of the word nigger by American citizens like Don Imus, Michael Richards, or any of the talented comedians appearing in the brilliantly offensive, Pimp Chronicles 2. The follow up to Katt William's wildly popular HBO stand up performance featuring Snoop Dogg, is being documented for a tentatively scheduled big screen release in September.

PIMP CHRONICLES ONE: KATT WILLIAMS HBO COMEDY SPECIAL
According to a recent U.S. Census Bureau report, the nation's minority population reached a milestone by surpassing 100 million and accounting for one in three U.S. residents. Of the estimated 100.7 million minorities in the United States, 44.3 million are Hispanic and 40.2 million are black.
Elizabeth Vargas's report attempted to analyze for network television the internal discord which exists within the black population in the United States over the word nigger. In his stand up act, Katt Williams tackles the issue head on by using the more socially acceptable ghetto slang version of the word, "niggaz", ad infinitum in his act. The intuitive comic handled the absurdity of the social divide created by the "N" word like a literary gangsta.
On stage, Katt Williams dealt with the mixed emotion over the word nigger by using the Modern Art Music Movement principle of raising awareness about serious social issues in a colorful, entertaining, and oftentimes controversial manner. He deftly pointed out the over reaction of Oprah Winfrey's attempts at banning the word nigger from the English language, in much the same way the Catholic Church announced to the world, in early 2007, that the State of Limbo officially ceased to exist. Referring to Steven Spielberg's Color Purple as a "nigger classic" Katt Williams observed, "[Oprah] forgets the reason we love her is because she herself is a nigger."

When asked by reporters to comment on the "comedic" use of the "N" word by Michael Richards during a recent stand up act at the Laugh Factory in Los Angeles, Katt Williams says he told the media, "I don't really give a fuck. If you want to call someone a nigger, you ought to say it in front of some niggers." He noted that had Michael Richards tried saying "Fuck you niggers!" in Miami, it would have been a really short show because, "Niggaz in the audience would have dragged his ass all the way to Seinfeld's house yelling, You best come get this Motherfucker!"

The use of the "N" word was not the only socially relevant topic to be tackled by the talented group of "Urban Comedians" on the Pimp Chronicles 2 line up. Red Grant, Luenell, and Melanie Camarcho helped Katt Williams entertain and raise awareness amongst Miami's melting pot audience of Black, White and Hispanic's at the packed James L. Knight Center.
Haters, Ho's, Niggaz, and Nigga Bitches were all dealt with matter of factly without prejudice or malice. "Too much crazy shit is going on in this fucked up world." Williams noted. "It's time to get our soldiers back from Iraq!" In analyzing the Beautiful Chaos that surrounds the civil war in Iraq, he asked the audience:
"How the fuck you supposed to scare somebody who already wants to die?
Those motherfuckers are true gangsta's! They don't be bluffing or bullshitting!"
Referring to the videotaped executions of American's broadcast on Al-Jazeera and the internet after 9/11, the audience's laughter was not meant to dishonor those who died for freedom, rather it seemed to be a cathartic moment for the audience searching for levity in a war torn world. With the help of Katt Williams the audience was able to collectively acknowledge the fact that they were all members of the Lied To Generation who had subconsciously had their patriotism manipulated by their leadership for sake of greed.

WORLD WAR III BY VICTOR-HUGO FROM THE WORLD TRADE CENTER TRIBUTE SERIES
By proclaiming, "I'm proud to be an American!" Katt Williams joined artist Victor-Hugo as a Modern Art Music Movement Gangsta. The two diminutive modern artists have developed a knack for teaching urban family values using true tales of adopted crackhead baby nightmares and crackhead Jesus CEO's and their Jewish attorney's. The two MAMM artists are spreading knowledge through laughter and entertainment to those open minded and intelligent enough to know how to teach the world's Bitch Niggaz how to properly perform cunninglingus on a woman like Luenell.

Inside, the Pimp Chronicles 2 participants were giving raunchy seminars on life, love, friends, and family to the ethnically diverse crowd. The enlightened and open minded multi-cultural audience embraced the beautiful verbal chaos which spewed from the stage, covering the audience like a golden shower of political incorrectness.

Referring to the political run for the White House in 2008 by minority candidates like Borack Hussein Obama and dark horse presidential candidate Victor-Hugo, Katt Williams noted, "Niggers are trying to figure out how they are going to feed their family in June more so than who will be President in 2008."
A recent independent poll showed that people were more familiar with the name Victor-Hugo than Barack Obama and would feel more comfortable having a Commander in Chief named Victor-Hugo than Barrack Hussein Obama. Both have been trained to fight in extreme circumstances but both men stressed that their battles are executed with the utmost respect for human life. Tito Ortiz conducts his battles in a caged ring using his fists, cunning, and brawn while Victor-Hugo has been conducting his battles using a paintbrush, camera, and a pen. In their Miami meeting, they discussed their mutual philosophy of fighting a fair fight. The two also discussed the U.S. conflict in Iraq.
Most notably, Tito's recent offer to visit the U.S. troops in Iraq, which was met with controversy, because the U.S. military objected to the fact that Tito Ortiz was involved in a loving relationship with adult film superstar, Jenna Jameson. In their meeting at the Exxxotica Convention, the two discussed the hypocrisy behind the U.S. government's attempts to dissuade Tito from extending his patriotism to the troops because of Jenna Jameson's career choice as an adult film actress.

One of the most popular BLOG entries in the evolving, interactive on line modern art graphic novel entitled "Capicua 3-1-3: The Long Arm of the Law", is the curious May 9,06 chapter entitled, "Are Nuclear Subs Filled With Human Timebombs?". International media outlets have begun to take notice of a matter which is of global importance; the psychological health of those entrusted by the U.S. government and its citizens, to safeguard the housing of MK 48 Torpedoes, cruise missiles, and nuclear warheads during a time of war. This issue was called into question by the dark horse U.S. presidential candidate, Victor-Hugo, in one of his modern art paintings. After being contacted by several news organizations regarding this startling entry, the artist/author, was asked to provide an explanation for the bizarre clues in his "Coloretti" painting. This Blog entry outlines the theories of his speculation regarding the unsolved Coloretti case for journalists and concerned citizens to examine and analyze.
May 4th marked the one year anniversary of this disturbing incident, which occurred in Fort Lauderdale, Florida during Fleet Week. The artist claims his enigmatic painting was originally titled "Life". An enscryption signed and dated May 8, 2006 can be found on the back of the painting which reads:

So we chose to fight & Live for as long as we could.
The title of the painting was changed to "Cover Up" before finally being called "Coloretti" after the sailor who inspired the mystery surrounding both the painting and the international security incident.

There are 9 "torpedoes" shaped like wooden phallic symbols representing the politics of the penis which have caused this story to be whitewashed by the media, at the U.S. military's request. Initially, the U.S. media was all over the arrest of Robert Coloretti, then suddenly and without explanation, news agencies backed off. Recently, mainstream media has been criticized for facilitating the orchestration of an international crisis by perpetrating the fraudulant existence of weapons of mass destruction to promote the civil war in Iraq. In its failure to notice the global implications of the Coloretti case, the mainstream media has failed to perform its duty of keeping the public well informed.

The first wooden phallic torpedo introduces the long list of characters in this play. The list is meant to highlight the possibility that a large group of people can be tangentially involved in a cover up, without causing public alarm. The first torpedo also calls to mind the March 13, 2006 www.vhvii.com Blog entitled, "9/11 Video Raises Disturbing Questions", which deals with 9/11 conspiracy theories and cover up issues perpetuated by a lack of public awareness. Attorney Joe Fazone, Captain Kevin Sheehan, Chief Bruce Roberts, Detective Charles Sierra, Sergeant Randy Pelham, Sergeant Mike Arbit, Officer Juan Cabrera, Captain Harrington, Exectuve Officer Bobby Carter, Vince Maffei Jr., Lt. Mike Dimaggio, Sgt. Ken Kelly, Officer Louis Alvarez, Officer Patrick Hart, Fire Inspector Bruce Strandhagen, Attorney Jeffrey Weizenger (Weiner), Petty Officer 2nd Class Robert Coloretti, and Lt. Karen Deitrich.

The second wooden phallic torpedo shows three ethereal figures at the tip. The figures appear to be engaged in some sort of sexual act. One of the bizarre figures is intertwined with the second and third phallic torpedo.

On the night of Coloretti's arrest, his spontaneous statement to Det. Charles Sierra was that he saw a fire on board the 44 foot yacht, named Ida II, which was docked on the New River. He claims to have acted instinctively when he boarded the vessel in an attempt to put out the fire. When asked by Det. Sierra why he would attempt to fight a fire aboard a ship that was not his own, Coloretti told the arson investigator that as a Navy man, "80 percent of my training is to fight fires aboard ships." In his initial statement, Coloretti also claimed to have seen someone jump overboard when he boarded the yacht.
Despite this claim by Coloretti, the Fort Lauderdale Police Department failed to conduct a Marine Unit search of the perimeter surrounding the yacht. Inexplicably, records indicate that the Fort Lauderdale Police Department also neglected to conduct a helicopter search for a possible suspect who may have jumped overboard.

The boat captain of the Ida II claims he was sleeping when he heard some banging and crashing noises on the top deck of the yacht. He says he assumed it was a mate of his who supposedly was hanging out on Las Olas. Rather than dialing 911 to call the police once his suspicion grew, the boat Captain says he sent several text messages to his mate, one of which stated, "What's going on up there?"
The obvious question is, why would anyone send text messages to a friend once they suspected they were in the middle of an intrusion? Since text messages are deleted from records after five days, Det. Sierra suggested a hold letter be sent to the cellular provider. A subpeona was placed on all text messages sent by the boat Captain on the night of the incident.
The boat captain claims he never saw Coloretti until after he got off the yacht at which point he called 911.

Sgt. Ken Kelly was one of the first police officers to arrive at the scene of the crime, around 11:30 p.m. He arrived with the entire tactical unit in tow. The tactical unit was begun early in 2006. Supposedly, Sgt. Kelly claims to have seen Robert Lee Coloretti lighting walls on fire aboard the Ida II near the midnight hour. According to witnesses, this claim seems implausible since the windows of the yacht had a very, very dark tint.
The initial lead detective was Charles Sierra, a twelve year veteran of the Fort Lauderdale Police force who spent most of his tenure as an investigator. Detective Sierra had three and one half years of arson unit experience, five years in a violent crimes unit, two years on narcotics, one year in burglary, and one year on street patrol. He was a decorated officer whose Internal Affairs file shows a spotless record until the Coloretti case.
Despite his never having attended the Fire Academy in Baltimore, Maryland, Det. Sierra was respected as a seasoned arson investigator. He resigned as arson investigator claiming he was overworked. Sgt. Randy Pelham convinced Det. Sierra to return as an arson investigator citing a lack of experienced arson investigators. The night of the Coloretti incident was Det. Charles Sierra's first night back on the job, as an arson investigator for the Fort Lauderdale Police Department.
The responding detective, Charles Sierra, was relieved of his duties because his commanding officer felt he was not being impartial in his investigation of the crime. Allegations were made that Det. Sierra was undermining a slam dunk case for the newly formed Tactical Unit by aiding Joe Fazone, Coloretti's initial attorney, when Det. Sierra arranged for himself, Fazone, and Sgt. Randy Pelham to fly to Norfolk, Virginia in an attempt to interview two witnesses that were vital to the case.

Initially, for reasons unknown, the U.S. Navy denied that Robert Lee Coloretti had gone on shore leave with two other Navy enlisted men on the night of the incident. Fazone located the two individuals in Norfolk, Virginia and immediately contacted Det. Sierra. The detective was informed that both sailors were set to leave for an extended tour of duty at sea within days.
Detective Sierra claims he purchased the three tickets with the intention of being reimbursed. His attempt to deal with an extinguishing time frame with which to interview two witnesses who could possibly shed some light on this mystery was met with a formal investigation and an Internal Affairs reprimand.
This begs the questions:
Why would the U.S. Navy lie about the two witnesses on shore leave with Coloretti?
Why would the Fort Lauderdale Police Department railroad a decorated, seasoned, veteran officer without a single blemish on his twelve year record, for attempting to properly investigate a potential matter of international security? It appears the detective who tried to conduct a proper investigation was relieved of his duties for attempting to go beyond merely scratching the surface of presented evidence.
When the two sailors contacted the Fort Lauderdale Police Department to give their statements over the phone as witnesses, it is alleged that Sgt. Pelham refused to take the statements saying, "If this isn't earth shattering, I don't want to hear it!"
Why would Sgt. Pelham hang up the phone without taking statements from the witnesses?

Coloretti's fingerprints did not show up on the lighter taken by Officer Juan Cabrera at the scene of the crime. In fact, there is no forensic evidence pointing to Coloretti as having lit a match or used a lighter to set the fire on board the Ida II.
Eyewitnesses on the scene report that it looked like a senseless act of rage led to the action of arson. It appeared as if someone had attempted to set the fire retardant sofa and pads on fire using punctured gas cans which were thrown around the yacht.
Sgt. Mike Arbit allegedly noted footprints found at the scene matching Coloretti's Navy issued shoes as sufficient evidence to successfully prosecute the case which may effectively have influenced Capt. Sheehan's opinion and handling of the investigation. Legal experts believe the overall lack of forensic evidence leads the upcoming Coloretti trial into a problem of proving possibility of action.

There is no question that arson was committed on board the Ida II on the night of May 4th 2006. The question is, if Petty Officer 2nd Class Robert Coloretti committed the crime, why did he do it? If not him, who did it? Was there a third person aboard the yacht who jumped overboard and failed to be found because the police neglected to conduct a proper search?
The clues left behind in this unsolved mystery have lead some to speculate that perhaps this was a gay domestic dispute. This theory is hinted at in the 7th wooden phallic torpedo found in Victor-Hugo's Daliesque painting. This torpedo which most resembles the male sexual organ also contains the image of what appears to be a pregnant female at the bottom, near the tip of the torpedo.
When Coloretti was arrested he was in his Navy uniform. Television news footage shows him in civilian clothing. Why? Perhaps because the Navy felt the image of a U.S. soldier in handcuffs was not the proper thing to broadcast during a time of war. When Coloretti's clothing was put in for evidence his wedding band was found in his pocket, not on his ring finger.
According to Coloretti's wife, the couple was experiencing difficulties in their marriage due to his extended tour of duty aboard the USS Hampton Submarine.
This alone is only circumstantial and insufficient to raise suspicion of a gay triangle involving a trio of sailors, but the little known fact that the three individuals on the Ida II that night all resided within a quarter mile of one another in Virginia should raise some eyebrows.
Is it possible that Coloretti ditched his shore leave companions to go meet with his secret lover on board the Ida II? Did this encounter lead to a quarrel between him and the individual he claims jumped overboard? Witnesses say the scene looked much like what is encountered after a gay domestic dispute. Is the Navy trying to hide the notion that there could possibly be mentally unstable homosexuals on board nuclear submarines?
It is no secret that the military policy of, "Don't ask. Don't tell.", does not discourage homosexuals from joining the Navy but merely forces this group of individuals to be clandestine with their sexual activities. Victor-Hugo claims that during his stint at both the Newport, Rhode Island Naval Base and the United States Naval Academy in Annapolis, Maryland he encountered and witnessed several homosexuals within his ranks, some of which were discharged due to their alternative sexual proclivity.

The fifth wooden phallic torpedo contains the insignia of a Fire Control Technician. Robert Lee Coloretti was a Fire Control Technician aboard the USS Hampton. Fire Control Technicians maintain the electronic equipment used in submarine weapons systems. They are responsible for the operation and maintenance of the complex electronic, electrical and mechanical equipment required to ensure the accuracy of Navy guided-missile systems and underwater weapons. They are also responsible for ship safety by recognizing and analyzing data from several critical systems including sonar, radar, periscope, radio, and torpedo inputs. Fire Control Technicians are responsible for the submarine's internal LAN system as well.

Despite the fact that Coloretti's XO and Master Chief vouched for him 100%, he remains the only likely suspect at this time and faces life in prison if convicted on charges of arson and burglary.

MODERN ART EXAMINES FISTING FETISH
Following the June 10, 2006 Blog entitled "FIST LOVING GRANDMOTHERS KILL FREE SPEECH ON www.VICTORHUGOGALLERY.COM" modern artist Victor-Hugo claims to have received a flood of inquiries and comments from around the world regarding the alternative sexual practice known as fisting. The overwhelming popular interest in this sometimes dangerous sex act forced the artist to deal with and investigate this sex act. The maverick artist says his intention was to educate visitors of his adult oriented, modern art web site, through his writings and art work, without offending any particular group. After the censored 6/10/06 article, the artist realized his audience included legal scholars, medical students, journalists, single mothers, high school students, government officials, and educators as well as individuals involved in socially alternative or deviant behavior.

FISTING
The practice of fisting is seldom talked about in public and has never been dealt with in the mainstream media. This accounts for why the popular practice is actually considered more of an underground fetish than golden showers or kaviar, both of which are most commonly practiced in Germany and Asia. The rapid growth of the internet has raised awareness about this extreme sexual act which is undertaken by women and men. Essentially fisting is a sexual activity that involves inserting the hand and forearm into the vagina or anus by a sexual partner or by one self as a form of masturbation.

FIST OF PEACE
Victor-Hugo says in analyzing audience and search engine statistics for his web site, he realized that amongst those Googling references to modern art, music, legal cases, womens issues, French author and poet Victor Hugo, and South Florida Real Estate, were a large number of people referencing fisting. He says he began consulting with his friends in the medical, homosexual and fetish community to learn more about this practice.
According to his research, fisting does not involve forcing the clenched fist into the vagina or anus rather, all five fingers are kept straight and held as close together as possible, then slowly inserted into a well-lubricated vagina or anus. Once inserted, the fingers either clench into a fist or remain straight. More rigorous forms of fisting include "punching", wherein a fully clenched fist may be inserted and withdrawn rapidly. More experienced "Fistees" may take two fists known as "double-fisting" in the vagina or anus, in which case, pleasure is derived more from the stretching of the anus or vaginal wall, than from the thrusting movement of hands.

The incidence of methamphetamine usage during fisting has increased along with the rise in its use among the general population. Muscle relaxants like amyl nitrite and the more common isobutyl nitrite are sometimes used as an adjunct to fisting.

MODERN ART EXPLORES CANADA'S WORST SERIAL KILLER ROBERT WILLIAM PICKTON
Controversial modern artist Victor-Hugo says he was fascinated by the story of Robert William Pickton, a Canadian pig farmer accused of killing over 26 women in Vancouver's impoverished Downtown Eastside neighborhood in the 1990's. The artist says he included the gruesome story of the Canadian trial in his painting, "Headlines", because he wanted to raise awareness about this story which was over looked by the U.S. media.

ROBERT WILLIAM PICKTON
Immediately following the arrest of Robert William Pickton,56, in February of 2002, health officials issued a tainted meat advisory to neighbors who may have purchased pork from his farm, claiming that the meat he sold them may have contained human remains. Pickton was arrested after traces of DNA of several victims were found on his pig farm.


Victor-Hugo says he plans to incorporate the trial presided over by British Columbia Supreme Court Justice James Williams, in his Capicua 3-1-3:The Long Arm of the Law graphic novel. He plans to study and analyze the thought process of Pickton's defense attorney, Peter Ritchie. The artist will have Ritchie join the fictitious law firm of Conde, Cohen, Gaeta, Martinez, Tupac, and Biggie Smalls from his controversial Crackhead Jesus and the Jewish Attorney parody to discuss defense tactics for Pickton who has plead not guilty.

ATTORNEY PETER RITCHIE
The artist, an advocate for womens rights, says he was initially drawn to the case in 2002. The Royal Canadian Mounted Police and the Vancouver Police Department received intense criticism by community activists who, along with advocates for sex-trade workers, claimed the authorities were slow to search for dozens of women who had disappeared in the area surrounding the pig farm for years.
The judge warned jurors hearing the trial of Robert William Pickton that they could expect to hear testimony "as bad as a horror movie." Jurors are expected to suffer from post traumatic stress syndrome following the trial. Evidence surrounding this case has been so gruesome, that some journalists covering the preliminary hearing had to seek psychological counseling to ward off nightmares.
The judge excused one juror who realized that this was a trial, not a movie and the jury did not have "the option of turning off the TV." Victor-Hugo says he chose to incorporate the story of Pickton in his Freedom of Speech Series painting when he realized that the trial would require an iron stomach from the jurors.
"I saw everyone involved in this case, from the Judge to the jury and even the attorneys as heroes because it is a true test of any legal system to conduct such a horrific trial." The artist said.

The bizarre paintings which encapsulate the overall Capicua 3-1-3: The Long Arm of the Law contain clues and references to news stories and events in modern history. The artist says his paintings serve as a modern art newspaper. His colorful paintings and writings cover stories which might otherwise slip through the cracks of mainstream media outlets.

JONATHAN SANTLOFER JOINS VICTOR-HUGO IN NEW WAVE OF AUTHOR/ARTISTS AND GRAPHIC NOVELS
With the release of Jonathan Santlofer's new book, Anatomy of Fear, the author/artist joins the growing trend of graphic artists who seemlessly incorporate their writing skills into their artwork. Modern artist Victor-Hugo says he is presently in negotiations with publishing companies interested in his unique body of work.

In the meantime, Victor-Hugo is including excerpts from his modern art graphic novella entitled, Capicua 3-1-3: The Long Arm of the Law, on his blog for fans who are eagerly awaiting the release of his diary of the world on canvas in hardcover.

Santlofer considers his new book a bridge between traditional novels and the graphic novel. Santlofer,59, in an interview by Carol Memmott of USA Today says he is trying to create a niche. Like Victor-Hugo, Santlofer uses his artwork to deliberately advance the plot of his story.

Like Victor-Hugo, who turned to writing after his artist studio was vandalized and burglarized in what he calls a clear case of censorship, Santlofer turned to writing after a Chicago gallery fire destroyed most of his work.
"Writing is more of a challenge," Santlofer says. "Drawing comes more naturally to me, but there is no question that they influence each other in my work."
Victor-Hugo agrees with Santlofer's statement adding,
"With most of my work destroyed I practically had to start from scratch. I found a means of expressing myself through my artwork and writings. As a matter of happenstance, it turns out my diary of world events on canvas has found appeal in a much wider audience."
The artist says following the Miami Herald article about the unsolved theft of his controversial anti-war artwork, he met several people including other censored artists and musicians who could commisserate with his situation. Soon after, Victor-Hugo joined other artists including 2 Live Crew and Crosby, Stills, Nash, and Young on a Freedom of Speech Tour during the summer of 2006.

According to population estimates by the United States Census Bureau the state of Florida is still within the top ten fastest growing populated states in the country. Data collected from the Department of Housing and Urban Development estimates that over 744,000 people in the United States are homeless. TROPICAL STORM ANDREA AWAKENS FEARS CAUSED BY GRAND VIEW PALACE SCANDAL
Bill Proenza, director of the National Hurricane Center, has warned that the 2007 hurricane season will be more active than normal because the El Nino weather pattern that suppressed hurricane development in 2006 has diminished. Tropical storm activity is expected to increase inland due to shifting wind patterns. Tropical storm Andrea is the first named storm of 2007. The Atlantic hurricane season does not even begin until June 1st. Hurricane forecaster William Gray of Colorado State University has predicted seventeen named storms during this anticipatedly active season.

A reader recently asked Victor-Hugo to comment on the marriage of Wook Kundor, 104, to Muhamad Noor Che Musa, 33, in Malaysia.
This is Muhamad's first marriage and Wook Kundor's 21st marriage. According to Muhamad, the fact that Wook was childless, old, and alone caught his eye and despite the fact that Wook had no money, he felt compelled to walk down the aisle to take Wook as his bride at the altar.

In the United States culture, it is not uncommon for older men to marry or court younger women but a new study reveals that women who marry younger men usually live longer than those with husbands older than themselves.
Laurel Klinger-Vartabedian, an associate professor of communication at Amarillo College in Amarillo, TX, and social psychologist Lauren Wispe of the University of Oklahoma, analyzed data from the U.S. Bureau of the Census and the U.S. National Center for Health Statistics for women from 50 to 74 years old. They compared the number of actual deaths to the expected death rates for women married to men of various ages.
The researchers found that among women whose husbands were between 6 to 14 years younger than they were, 30% lived longer than expected, while among those whose spouses were 6 to 14 years older, 67% died sooner than expected. For women who were married to men approximately the same age as themselves (+ or -4 years), 14% lived longer than expected.

A WOMAN ALWAYS SEES WHAT SHE WANTS TO IN A MAN BY VICTOR-HUGO
John T. Molloy in his book, Why Men Marry Some Women and Not Others, notes that there is an age when a man is ready to marry. He calls this, the Age of Commitment, which varies from man to man. According to surveys conducted by John T. Molloy and his research staff, the following observations were made:
• Most men who graduate from high school start thinking of marriage as a real possibility when they are twenty-three or twenty-four.
• Most men who graduate from college don't start considering marriage as a real possibility until age twenty-six.
• When men go to graduate school, it takes them longer to get into the working world, and they're not ready to get married until a few years after that.
• Ninety percent of men who have graduated from college are ready for the next step between ages twenty-six and thirty-three; this is when they are most likely to consider marriage. But this window of opportunity stays open only for four to five years, and then the chances a man will marry start to decline.
• A majority of college graduates between twenty-eight and thirty-three are in their high-commitment years and likely to propose.
• This period for well-educated men lasts just a bit over five years. The chances men will commit are sightly less when they are thirty-one or thirty-two than when they were between twenty-eight and thirty, but they're still in a high-commitment phase.
• Once men reach thirty-three or thirty-four, the chances they'll commit start to diminish, but only slightly. Until men reach thirty-seven, they remain very good prospects.
• After age thirty-eight, the chances they will ever marry drop dramatically.
• The chances that a man will marry for the first time diminish even more once he reaches forty-two or forty-three. At this point, many men become confirmed bachelors.
• Once men reach age forty-seven to fifty without marrying, the chances they will marry do not disappear, but they drop dramatically.

John T. Molloy believes there is a point at which men are likely to be ready for marriage, but the specific age depends on the man's maturity, education, and profession. He offers the following statistical truths about men:
• Most men will not even consider marriage before they reach the age of commitment. For 80 percent of high school graduates, the minimum age of commitment is twenty-three, whereas for 80 percent of college graduates, it's twenty-six.
• The high-commitment period for most college-educated men is from ages twenty-eight to thirty-three.
• For men who go to graduate school-doctors, lawyers, and the like-the high-commitment period runs from thirty to thirty-six.
• After age thirty-seven or thirty-eight, the chance that a man will commit diminishes. After forty-three, it diminishes even more.
• Most men think sowing their wild oats is a rite of passage and will not even contemplate marriage until they have been working and living as independent adults for several years.
• Men are most likely to marry after they become uncomfortable with the singles scene.
• Men have biological clocks. They want to be young enough to teach their sons to fish and play ball, and to do the male-bonding thing.

• Men whose parents divorced when they were young are often gun-shy about marrying.
• Men often marry women whose backgrounds- religion, politics, values, socioeconomic status- match theirs.

• If a man over the age of forty has been married before, he is more likely to marry than a forty-year-old man who has never been married.

VICTOR-HUGO SEEKS AL GORE TO FORM THIRD PARTY IN 2008 U.S. PRESIDENTIAL ELECTION
The dark horse 2008 U.S. Presidential candidate says he is not out of the Presidential campaign yet. Answering questions from reporters in Sydney, Australia and Shanghai in the People's Republic of China, Victor-Hugo said he was simply waiting on the sidelines with Al Gore, to see how the other candidates faired in their debates.

Victor-Hugo notes the second round of the French election, this weekend on May 6, as a good example of modern democracy. With French voters set to choose a successor to President Jacques Chirac on Sunday, French election law forbids any campaigning or media coverage on the weekend of the vote. The center-right candidate, Nicolas Sarkozy is leading Segolene Royal and predicted to be the winner after outshining his rival Royal in the campaign's televised debate. The winner will be the first French president of The Lied To Generation. Both Sarkozy and Royal were born after World War II.
The New York City native says he is uninspired by the 2008 U.S. Presidential candidates of either the Republican or Democratic party. He says the candidates lack any soaring vision or expression of visionary ideas. In his opinion, the winning candidate should be willing to have the strength and fortitude to use common sense and be the voice of the people.
"It amazes me that being honest and fallible is seen as a weakness in the United States. I am far from perfect and do not claim to be. My goal in office would be to help decrease the amount of corruption which exists in our government. It seems the problem with America today is that criticism is perceived as counter to democracy.
Celebrities like Alec Baldwin and David Hasselhoff should not be the only ones in America held to impossibly high standards of being. Public officials and public servants should be able to accept and give criticism without being labeled unpatriotic. The underdog Hispanic candidate openly proclaims that the U.S. government is flawed, unlike most of the Presidential candidates who are unwilling to admit that there is anything wrong with the United States government. Analysts say his open admission of faults makes him more believable and sincere in the eyes of the public.
"To say that I don't believe in evolution would make me appear illogical and to say that I believe everything is right with the United States government would make me appear ignorant. I simply say, I believe in democracy and the right of people to govern themselves in a peaceful manner using common sense, science, and a sense of ethics."
Political analysts are comparing Victor-Hugo to Taiwan's Vice President and dark horse presidential candidate, Annette Lu. NEW YORK, Feb. 7, 2007—Controversial Latino modern artist Victor-Hugo Vaca II, a native of Queens, N.Y., announced today his plans to pursue a spot on the 2008 presidential electoral ballot, taking on frontrunners Hillary Clinton and Barack Obama.
The artist said in a public statement that he will try to run for president while he continues to research his “Law and Justice in the United States” series of works.
The point of running for office, he explained, would be to educate his fans on the difficulty or ease with which a native-born American citizen can run for “the most powerful position in the world.”
He added that he hopes the investigation and his bid for the presidency inspires the “lied-to generation” to get more involved with politics and heed the warnings in Al Gore’s film, An Inconvenient Truth.

PARIS HILTON SENTENCED TO 45 DAYS IN U.S. JAIL WHILE DICK CHENEY GREETS QUEEN ELIZABETH IN JAMESTOWN VIRGINIA
Superior Court Judge Michael T. Sauer sentenced Paris Hilton to 45 days in jail for violating her probation. Paris Hilton, must go to jail on June 5. Judge Michael T. Sauer ruled after a hearing that she would not be allowed any work release, no furloughs, no use of an alternative jail and no electronic monitoring in lieu of jail. In Jamestown Virginia, meanwhile, Dick Cheney, whose abuse of power has cost thousands of innocent lives, was greeting Queen Elizabeth.

Paris Hilton, 26, arrived at the Metropolitan Courthouse 10 minutes late in the back of a black Cadillac Escalade. United States Vice President, Dick Cheney, is reported to have arrived on schedule for his meeting with Her Majesty, The Queen of England.
Paris Hilton was seen rushing into the court with several men in suits, presumably her attorneys, as throngs of photographers and media outlets lined the route into a rear entrance of the court. Her parents, Rick and Kathy Hilton, were present at the hearing.

She had signed a document acknowledging that she was not to drive, according to papers filed in Superior Court.
